SoundScape

By downloading, installing, or using SoundScape (“the App”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, please do not use the App. These Terms constitute a legal agreement between you and BigDevelop (“we,” “our,” or “us”).

We grant you a limited, non-exclusive, non-transferable, revocable license to use SoundScape on any Apple device that you own or control, subject to these Terms and the Apple App Store Terms of Service.

When using SoundScape, you agree to:

• Use the App in compliance with all applicable laws and regulations
• Not attempt to reverse engineer, decompile, or disassemble the App
• Not use the App for any purpose that could damage, disable, or impair the App
• Not redistribute or resell the App itself

You are solely responsible for the content you create using the App. This includes:

• Custom sound mix configurations
• Sleep timer preferences
• Favorite sound selections

The App, including its design, code, graphics, user interface, and all related intellectual property, is owned by BigDevelop and is protected by copyright and other intellectual property laws.

SoundScape is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.

Limitation of Liability

To the maximum extent permitted by applicable law, BigDevelop shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your use of or inability to use the App.

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the appropriate courts of the jurisdiction in which BigDevelop operates.

Changes to Terms

We reserve the right to modify these Terms at any time. Your continued use of the App after any changes indicates your acceptance of the revised Terms.
